I. INTRODUCTION
Schnucks Meal Creations is a convenient service offered to you by Schnucks, where we make it easy. Please ready these Rules and Requirements (these “Rules”) carefully. By registering for or using Schucks Meal Creations, you accept and agree to be bound by these Rules. In addition to these Rules, registration for and use of Schnucks Meal Creations is subject to the Schnucks Family of Websites Terms of Service Agreement, located at http://www.schnucks.com/_____, and incorporated herein by this reference.
II. SCHNUCKS MEAL CREATIONS RULES AND REQUIREMENTS
By registering for or using Schnucks Meal Creations, you hereby represent and warrant that you can and will abide by the following rules and requirements:
1. I agree to comply with all rules for the Schnucks Meal Creations program posted on this website. emailed by Schnucks to me, and/or made available at a preparation location, and all reasonable instructions of Schnucks staff members.
2. I agree not to attend any Schnucks Meal Creations session if I have or have been exposed to any contagious illness.
3. I agree to wash my hands carefully before beginning to assemble each Schnucks Meal Creations product, after using the restroom, and as otherwise appropriate to maintain a sanitary environment.
4. I assume full responsibility for the transportation, proper storage, and preparation of all of my Schnucks Meal Creations products. Without limiting the foregoing:
(a) I agree to freeze my Schnucks Meal Creations products promptly following the conclusion of each assembling session.
(b) I agree to thaw my Schnucks Meal Creations products in the refrigerator before cooking.
(c) I agree to follow the cooking instructions specified on each Schnucks Meal Creations product.
(d) I agree to consult with my physician or other healthcare professional if I have any questions or concerns about preparing or consuming any Schnucks Meal Creations products, including whether a Schnucks Meal Creations product meets my allergy requirements.
5. I agree to use Schnucks Meal Creations for the personal, non-commercial use of myself and my family. I will not resell my Schnucks Meal Creations products or use them in or as part of any commercial service.
6. I agree to indemnify, hold harmless, and release Schnucks, its owners, employees, agents, affiliates and suppliers from and against any and all claims, damages and causes of action or liabilities of any kind that may arise out of or result in whole or in part from my use or misuse of Schnucks Meal Creations, my transportation, preparation, storage, or consumption of Schnucks Meal Creations products, and/or my violation of these Rules.
III. Allergy Alert
Schnucks Meal Creations facilities and products may contain Milk, Eggs, Fish, Crustacean Shellfish, Wheat, Soybeans, Peanuts, Tree Nuts and/or other allergy-related ingredients. you are solely responsible for determining whether a schnucks meal creations PRODUCT meets your and your family’s allergy requirements, and should consult with a physician or other healthcare professional whenever in doubt.

V. DISCLAIMER
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCHNUCKS MEAL CREATIONS IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. SCHNUCKS AND ITS OWNERS, EMPLOYEES, AGENTS, AFFILIATES AND SUPPLIERS MAKE NO REPRESENTATIONs OR warranties of any kind, EXPRESS OR IMPLIED, REGARDING thE SCHNUCKS MEAL CREATIONS PRODUCTS OR SERVICES, YOUR USE OF SCHNUCKS MEAL CREATIONS, OR COMPLIANCE OF THIRD PARTIES WITH THE SCHNUCKS MEAL CREATIONS RULES AND REQUIREMENTS, AND EXPRESSLY DISCLAIM any WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Vi. Limitations on LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (1) IN NO EVENT SHALL SCHNUCKS OR ITS OWNERS, EMPLOYEES, AGENTS, AFFILIATES OR SUPPLIERS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR SIMILAR DAMAGES ARISING OUT OF OR RELATED TO SCHNUCKS MEAL CREATIONS; AND (2) THE TOTAL CUMULATIVE LIABILITY OF SCHNUCKS AND ITS OWNERS, EMPLOYEES, AGENTS, AFFILIATES AND SUPPLIERS ARISING OUT OF OR RELATED TO SCHNUCKS MEAL CREATIONS SHALL NOT EXCEED THE TOTAL FEES (IF ANY) PAID BY YOU IN THE PRIOR ONE MONTH FOR THE PRODUCTS AND/OR SERVICES GIVING RISE TO THE CLAIM, IN EACH CASE REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE EXISTENCE OF MORE THAN ONE CLAIMS OR SUITS SHALL NOT EXPAND THIS LIMITATION.
